Please read the terms written below in order to use this website (hereinafter referred to briefly as the “SITE”). All real and legal persons who benefit from the services offered on this SITE or who access the SITE in any way shall be deemed to have accepted the following terms of use.

The services offered on this SITE are provided by İleri Trafik Sinyalizasyon San. Tic. Ltd. Şti. (hereinafter referred to briefly as “İLERİ TRAFİK”), and the legal owner of the SITE is İLERİ TRAFİK. All rights of use and disposition over the SITE belong to İLERİ TRAFİK.

İLERİ TRAFİK may amend these terms of use at any time; however, such amendments shall be published regularly on the SITE and shall enter into force as of the same date.

All real and legal persons who benefit from the services of the SITE and who access the SITE shall be deemed to have accepted in advance all changes made by İLERİ TRAFİK to the provisions of these terms of use.

İLERİ TRAFİK reserves the right to change at any time the information, forms, and content available or to be made available on this SITE.

SITE: The website accessible in an online environment where various services and content are offered within the framework determined by İLERİ TRAFİK.

MEMBER: Any real or legal person who wishes to benefit from purchasing products from İLERİ TRAFİK, who completes the selected membership form in full, and whose membership is approved and accepted by İLERİ TRAFİK. They shall hereinafter be referred to as “MEMBER” in this agreement. Individuals who are over 18 years of age may become members by completing the relevant membership form on the SITE in full with their real identity information. Companies wishing to become members (sole proprietorships and partnerships), Collective Companies, Ordinary Limited Partnerships, Limited Partnerships Divided into Shares, Limited Liability Companies, Joint Stock Companies, Cooperatives, and other institutions may become MEMBERS by completing the relevant membership form on the SITE in full with their legal information through their authorized representatives over the age of 18 and may conduct transactions on behalf of their institutions. The “username” is unique to the member, and the same “username” cannot be assigned to two different MEMBERS.

USER: A person who visits the İLERİ TRAFİK website with or without making a purchase.

LINK: A connection that enables access from the SITE to another website, files, or content, or from another website to the SITE, files, or content.

CONTENT: All kinds of information, files, images, programs, numbers, prices, etc., visual, written, and audio materials published or accessible on the SITE and/or any website.

WEBSITE TERMS OF USE AND MEMBERSHIP AGREEMENT: This agreement concluded electronically between İLERİ TRAFİK and real and/or legal persons who will benefit from the commercial and personalized services offered via the SITE.

PERSONAL INFORMATION: Information such as the member’s identity, address, email address, phone number, IP address, sections of the SITE visited, domain type, browser type, visit date and time, etc.

The services to be provided by İLERİ TRAFİK via the SITE generally consist of electronic commerce as defined under Consumer Law legislation.

The services to be provided by İLERİ TRAFİK via the SITE include, but are not limited to, the delivery of products offered for sale at www.ileritrafik.com to the customer, without defects, by a cargo company on behalf of İLERİ TRAFİK within the committed period, provided that the MEMBER has paid the price and the supplier’s stock status is available, meaning that the obligation imposed on the seller by the contract—delivery of the goods—is capable of performance.

İLERİ TRAFİK is completely free to determine the scope and nature of the services it will offer via the SITE, and any changes it makes regarding the services shall be deemed to have entered into force upon their publication on the SITE.

In order to benefit from the services offered within the SITE, users must possess the qualifications specified by İLERİ TRAFİK and stated in the relevant section of the SITE. İLERİ TRAFİK is completely free to determine these qualifications, and any changes made regarding them shall be deemed effective upon publication on the SITE.

İLERİ TRAFİK continuously checks the accuracy and currency of the information available on the SITE. However, despite such efforts, the information on the SITE may lag behind actual changes. The materials and information contained on the SITE are presented as of the moment they are uploaded, and there may be differences between the current status of the relevant service or information and what is presented on the SITE. No explicit or implicit warranty or commitment is made regarding the currency, accuracy, conditions, quality, performance, merchantability, suitability for a particular purpose, or completeness of the information on the SITE, or its effect on other information, services, or products available on the SITE or otherwise related to or independent of them.

It is entirely the responsibility of USERS and MEMBERS to provide all necessary software and hardware requirements to prevent such malicious programs, ensure the accuracy of data input-output, and recover any lost data, as well as to perform maintenance and updates. İLERİ TRAFİK shall not be responsible for any damages that USERS, MEMBERS, or third parties may suffer due to data inaccuracies or losses caused by such malicious programs, codes, or materials.

İLERİ TRAFİK reserves the right to change, reorganize, suspend, or terminate the publication of any services, products, campaigns, and information available on this SITE and its extensions, as well as the terms of use of the SITE and the information presented on the SITE, without prior notice. Changes shall enter into force upon publication on the SITE. By using or accessing the SITE, these changes shall also be deemed accepted. These terms also apply to other web pages accessed via links. İLERİ TRAFİK accepts no responsibility for interruptions, errors, omissions, deletions, losses, delays in operations or communications, computer viruses, communication failures, theft, destruction, or unauthorized access to, alteration of, or use of records arising from breach of contract, tort, negligence, or other causes.

USERS and MEMBERS bear full legal and criminal responsibility for all transactions and actions they perform on the SITE. Each USER and MEMBER undertakes not to engage in any activity that infringes upon the rights of İLERİ TRAFİK and/or third parties. İLERİ TRAFİK bears no direct or indirect responsibility for damages incurred or that may be incurred by third parties due to the activities of USERS and MEMBERS on the SITE.

The owner of this SITE is İLERİ TRAFİK. All information, texts, images, trademarks, slogans, and other signs on this SITE, as well as programs designed to protect industrial and intellectual property rights, page layout, and presentation of the SITE, are the property of İLERİ TRAFİK or entities from which İLERİ TRAFİK has obtained permission and licenses. Partial or complete copying, modification, publication, transmission, distribution, sale, or use via online or other media of databases, websites, software codes, HTML codes, products, designs, images, texts, visual, audio, and other materials, video clips, files, catalogs, and lists contained on the SITE is prohibited. İLERİ TRAFİK may use information transmitted to it by USERS and MEMBERS via the SITE in accordance with the “Privacy Policy” and “Website Terms of Use.” Such information may be processed, classified, and stored in a database. İLERİ TRAFİK may also use identity, address, email address, phone number, IP address, visited sections of the SITE, domain type, browser type, visit date and time, etc., for statistical evaluation, campaign announcements, and offering personalized services. Personal information of USERS and MEMBERS shall not be disclosed to real or legal third parties except upon request by legally authorized authorities and in the cases listed below. Personal information may rarely be provided to third parties acting for or on behalf of İLERİ TRAFİK or related to its business, in order to better process the original purposes of use or to provide better services in line with the purposes suggested by USERS and MEMBERS.

Unless expressly authorized by İLERİ TRAFİK under these Website Terms of Use, İLERİ TRAFİK reserves all rights regarding its services, information, copyrighted works, trademarks, trade dress, and other assets and information provided through this SITE.

İLERİ TRAFİK shall not be liable for any direct or indirect damages arising from access to the SITE, use of the SITE or the information, data, programs, etc. on the SITE, due to breach of contract, tort, or other reasons. İLERİ TRAFİK accepts no responsibility for interruptions, errors, or omissions resulting from breach of contract, tort, negligence, or other causes. İLERİ TRAFİK may assign this agreement in whole or in part at any time without notice. However, USERS and MEMBERS may not assign this agreement or any part of it to another party. Any such attempt at assignment shall be invalid.

In all cases legally considered force majeure, İLERİ TRAFİK shall not be liable for late performance or non-performance of these “WEBSITE TERMS OF USE.” Such situations shall not be deemed delay, non-performance, or default on the part of İLERİ TRAFİK, nor shall any compensation obligation arise.

Any disputes arising from this “WEBSITE TERMS OF USE AND MEMBERSHIP AGREEMENT” shall be governed by Turkish Law, and Ankara Courts and Enforcement Offices shall have jurisdiction. İLERİ TRAFİK reserves the right to file a lawsuit in the country where the USER or MEMBER is located.

This “WEBSITE TERMS OF USE AND MEMBERSHIP AGREEMENT” shall enter into force on the date it is published on the SITE by İLERİ TRAFİK. USERS and MEMBERS shall be deemed to have accepted the provisions of this agreement by using the SITE. İLERİ TRAFİK may amend the provisions of this agreement at any time; amendments shall be published on the SITE with the version number and amendment date and shall enter into force on the same date.
